The United Kingdom's Department for Environment, Food and Rural Affairs (DEFRA) has opened a public consultation on the proposal to transpose Directive (EU) 2017/2102 amending Directive 2011/65/EU on the restriction of the use of certain hazardous substances in electrical and electronic equipment (RoHS 2) into UK law.
The UK has already implemented the provisions of RoHS 2, so this change would continue this law in the UK after the Brexit transition. The proposed UK law would come into effect on 29 March 2019, the day that Brexit becomes official. The UK's transposition would also retain the same July 2019 date for the effectiveness of the October 2017 RoHS 2 amendments
These proposed changes would thus continue the application of the provisions of RoHS 2 in the UK despite Brexit. RoHS restricts the use of hazardous substances in electrical and electronic equipment (EEE). The regulated substances currently include: lead, mercury, cadmium, hexavalent chromium, polybrominated biphenyls (PBB), and polybrominated diphenyl ethers (PBDE). As of 22 July 2019, four phthalates will also be restricted: DEHP, BBP, DBP and DIBP.
DEFRA is holding a consultation on this proposal until 4 December 2018. Companies, people or organizations with input on this plan may wish to provide their input before any concrete actions are taken.
